Y Customs Pty Ltd (ABN 26 696 374 320) respects your privacy. This policy explains what personal information we collect, how we use it, who we share it with and how you can access or correct it. We handle personal information in line with the Australian Privacy Principles in the Privacy Act 1988 (Cth). Where we deal with customers in the European Union or United Kingdom, we also take into account your rights under the GDPR and UK GDPR.

1. What we collect

  • Contact and identity details: your name, email address, phone number, and billing and delivery addresses.
  • Order details: what you bought, when, the order value, delivery and tracking information, and any notes you add to an order.
  • Vehicle details: make, model, year, trim and modifications, where you provide them for fitment checks, custom work or warranty claims.
  • Payment details: payments are processed by our payment providers, such as Shopify Payments, PayPal and buy now pay later providers. We receive confirmation of payment and limited details such as the last four digits of a card. We do not see or store your full card number.
  • Communications: emails, messages, calls, social media messages and reviews you send us, including photos and videos.
  • Technical and usage data: your IP address, device and browser type, pages viewed, referring site and cookie data collected when you use the site.
  • Marketing preferences: whether you have opted in to emails or SMS.

2. How we collect it

Directly from you when you place an order, create an account, contact us, sign up for marketing, enter a competition or interact with us on social media. Automatically through cookies and similar technology when you use the site. From third parties such as payment providers (payment status and fraud checks), carriers (delivery status) and social media platforms (public profile information when you contact us there).

3. Why we use it

  • to process, produce and deliver your order and provide customer service
  • to confirm fitment and to make custom or made to order parts
  • to handle returns, warranty claims and disputes
  • to prevent fraud and verify payments
  • to run and improve our website, products and service
  • to send you order updates and, if you have opted in, marketing about products, restocks and offers
  • to comply with legal obligations, including tax and record keeping
  • for any other purpose you consent to, or that is required or authorised by law

4. Who we share it with

We share personal information only where it is needed to run our business:

  • Shopify, which hosts our store and processes orders, and its service providers
  • payment providers and fraud prevention services
  • Australia Post, couriers and freight companies, so they can deliver your order
  • email, SMS and marketing platforms used to send you communications you have opted in to
  • our accountants, lawyers, IT providers and other professional advisers
  • government agencies, regulators, courts and law enforcement where required by law
  • a buyer or successor if we sell or restructure the business

We do not sell personal information.

5. Overseas disclosure

Some of our providers, including Shopify, payment providers and email platforms, store or process data outside Australia, including in the United States, Canada and the European Union. For international orders, your name, address and contact details are also provided to carriers and customs authorities in the destination country. We take reasonable steps to make sure providers protect your information appropriately.

6. Marketing

We only send marketing emails or SMS if you have opted in. You can opt out at any time by using the unsubscribe link in any email, replying STOP to an SMS, or contacting us. We will still send you service messages about your orders.

7. Cookies

Our site uses cookies and similar technologies. Some are essential for the site to work, such as remembering your cart and completing checkout. Others help us understand how the site is used (analytics) and measure and improve our advertising (for example Meta and Google pixels). You can control cookies through your browser settings and, where a cookie banner is shown, through the choices it offers. Blocking essential cookies may stop parts of the site working.

8. Security

Our store runs on Shopify, which is certified to PCI DSS Level 1, and all traffic to the site is encrypted. We limit access to personal information to people who need it. No system is completely secure, and we cannot guarantee the security of information sent over the internet.

9. How long we keep it

We keep order, invoice and payment records for at least five years to meet Australian tax and record keeping obligations. We keep other personal information for as long as we need it for the purposes above, then delete or anonymise it. Marketing data is kept until you opt out.

10. Access, correction and deletion

You can ask to access or correct the personal information we hold about you, or ask us to delete it, by contacting us using the details below. We will respond within 30 days. We may need to verify your identity first. In some cases we must keep certain information for legal reasons, and we will tell you if that applies.

If you are in the EU or UK, you also have rights to object to or restrict processing, to data portability and to withdraw consent, and you can complain to your local data protection authority.

11. Complaints

If you have a concern about how we have handled your personal information, contact us and we will investigate and respond. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner at oaic.gov.au.

12. Children

Our site and products are not directed to people under 18, and we do not knowingly collect personal information from them.

13. Changes to this policy

We may update this policy from time to time. The current version is always published on our site.
